General Instructions
You are included in the Settlement Class if you are a US resident whose private information was accessed in the targeted cyberattack against Hair Club for Men LTD, Inc. (“HairClub” or "HCFM") that occurred on or about October 17, 2023 (the “Security Incident”). You may have received a Notice Letter from HCFM notifying you that your personal information may have been involved in the Security Incident.
Excluded from the Settlement Class are: (a) directors and officers of HCFM (b) all Settlement Class Members who timely and validly request exclusion from the Settlement Class; and (c) the Judge assigned to the Action and their staff and family; and (d) any other person found by a court of competent jurisdiction to be guilty under criminal law of initiating, causing, aiding, or abetting the criminal activity occurrence of the Security Incident or who pleads nolo contendere to any such charge.
If you are a Settlement Class Member and wish to receive one or both of the following settlement benefits, complete a claim form by July 17, 2025.
Available Benefits
Settlement Class Members may claim only one of the two following Benefit Options:
Benefit Option 1: Compensation for Documented Unreimbursed Losses (up to $4,500) and Credit Monitoring Services. Unreimbursed Losses may include losses relating to fraud or identity theft; professional fees including attorneys’ fees, accountants’ fees, and fees for credit repair services; costs associated with freezing or unfreezing credit with any credit reporting agency; credit monitoring costs that were incurred on or after mailing of the notice of data breach, through the date of claim submission; and miscellaneous expenses such as notary, fax, postage, copying, mileage, and long-distance telephone charges. If your claim for documented out of pocket expenses is deemed invalid, your claim will automatically be converted to one for an Alternative Cash Payment under Benefit Option 2.
To claim Unreimbursed Losses payment, you must submit documentation, such as receipts, to verify the Unreimbursed Losses you incurred that were more likely than not caused by the Security Incident. You may submit “self-prepared” documents to add clarity or support to other submitted documentation, but self-prepared documents by themselves are not sufficient to file a valid claim.
In addition to the Unreimbursed Losses payment, you can receive three (3) years of Credit Monitoring Services that include up to $1,000,000 in identity theft insurance.
Benefit Option 2: Alternative Cash Payment of Seventy-Five dollars ($75). If you do not have documented Unreimbursed Losses, you will still qualify for the Alternative Cash Payment of $75. No documentation is required to get this payment.
To start your online claim form, you can find your Unique ID and PIN on the Notice that was sent to you. If you are unable to locate your Unique ID and PIN, please contact us by emailing info@HCFMSettlement.com. You will be asked to provide the Class Member’s full name and mailing address.
You may also download a Claim Form here, and submit it by U.S. mail to: Hair Club Security Incident Settlement, c/o Settlement Administrator, PO Box 26170, Santa Ana, CA 92799. An electronic image of the completed Claim Form can also be submitted by email to info@HCFMSettlement.com.
The deadline to submit a Claim Form online is July 17, 2025. If you are mailing your Claim Form, it must be mailed with a postmark date no later than July 17, 2025.
